Dear Kristoffer, I was very surprised to read your response. As you well know, since moving into our brand-new home we have been facing a long list of problems—problems that were officially recorded in the deed signed before the notary in December 2022. You signed this deed with the commitment to resolve these issues within three months, that is, by March 31, 2023. However, once again, these promises proved to be empty. The list contains ten items that required correction. Do you find it acceptable that, in the meantime, we have already had to personally cover various repairs ourselves, amounting to approximately €25,000, simply to keep the house livable? We have shown more than enough patience, but you continue to hide behind the excuse of not having sufficient financial means. Yet, as you are fully aware, I am the only one of the three buyers in this development who has always paid invoices on time—and I am now being penalized for it. You know very well that my review from three months ago was a cry for help. Only then did you react, making a quick attempt to “patch things up,” because never before had you responded to my messages or to my visits to your office. After your promise to proceed with the additional works together with Murprotec, you wrote in your reply to my review that you had “always been ready to help us.” This is simply not the truth. You also claim that Marbella Estates has nothing to do with these problems. It is indeed true that you and your partner created a temporary company to realize this small development of three houses, and that this company appointed a lawyer who never responds and who leaves no room whatsoever for negotiation, despite the clear mistakes made in this project. You are, in fact, the developers, and therefore you bear full responsibility for the choice of subcontractors used. I take your words seriously and look forward to a constructive resolution of all outstanding problems, which requires you finally assuming your responsibilities. I am awaiting, with some urgency, a proposal for a meeting together with your engineer Eloy. In the meantime, we have discovered yet another problem: the pool cover, which at Eloy’s request was installed inside the pool itself, is defective. Both the installer and another independent expert confirmed to me that such a cover should never have been installed in the bottom of the pool. As for your remark that I “love living in this house,” that I am not willing to leave despite the issues, and that the value of my property has risen by 50%—I can only take this with a pinch of salt, especially considering that the third house in this development has now been for sale for over six months. Marbella Estates just sold our home in La Cartuja del Golf, Atalaya. No secrets, we had listed our property by more than one Real Estate Agent. Based on the investment they made into selling (time and effort, not necessarily financially) and how they promoted the listing, we can say that the Marbella Estates Team stood out, for us, as the best Marbella has to offer. What can I say about David and his team absolutely fantastic service from start to finish. David took us round showing us properties which were exactly what we wanted to see and not like some of these cowboy's on the Costa del sol who show you rubbish and nothing like what you asked to see, suffice to say that we are now the proud owners of our dream home in Spain.
